New UNE standard for managing compliance in the area of free competition

The UNE 19603 standard lays out the requirements and directives to develop an effective compliance management system in organizations to comply with free competition.
  • The Standard is particularly applicable for managing and controlling risks in the area of free competition, establishing requirements and guidelines for having models that are consistent with the laws that apply to organizations operating in Spain, in terms of prevention, detection and response to practices that are contrary to free competition.
     
  • This standard is part of the UNE's strategy to effectively address the major challenges of Spanish organizations in ESG (environmental, social and governance) through the development of standards.
  • Madrid, 20 December 2023 - The Spanish Association for Standardization, UNE, has published a new standard that specifies the requirements and directives for establishing, developing, implementing, evaluating, maintaining and continuously improving a management system in organizations to comply with free competition.

    The UNE 19603 standard Compliance management systems in the area of free competition. Requirements with guidance for its use has been drawn up by the Spanish Association for Standardization, with assistance from the Basque Competition Authority and the participation and consensus of stakeholders (industry associations, government agencies, companies, consultancies and law firms, compliance associations, universities and certifying agencies).

    This standard is part of the UNE's strategy to effectively address the major challenges of Spanish organizations in ESG (environmental, social and governance) through the development of standards.

    This Standard lays out the requirements and recommendations for implementing an effective compliance management system in the area of free competition in all types of organizations, regardless of their size, nature or activity.  The standard is certifiable by an independent third party, such that organizations with a certified management system in place will be able to improve their reputation and image in the business sector.

    This text is particularly applicable for managing and controlling risks in the area of free competition, establishing requirements and guidelines for having models that are consistent with the laws that apply to organizations operating in Spain, in terms of prevention, detection and response to practices that are contrary to free competition.

    The Standard applies to the areas of anti-competitive conduct that can occur in an organization, and encompasses its major blocks: collusive conduct, abuse of dominant position, distortion of competition due to unfair acts, economic concentrations of organizations that are not reported or authorized, as applicable; and public aid or State aid that exceeds the regulatory limits and/or can restrict free competition.

    The UNE is the only standards body in Spain. By developing standards, it contributes to the shared progress of society and to building a safer, more sustainable and competitive world. UNE comprises over 500 members representing practically the whole of Spain's industrial network.
